Terms of Service

Welcome to KeysCast. These Terms of Service ("Terms") govern all digital media, videography, photography, and production services provided by KeysCast ("we," "us," or "our"), operated by Sam. By requesting a visual cost estimate, booking a production date, or using our deliverables, you ("Client," "Agent," or "Broker") agree to comply with and be bound by these Terms.

1. Scope of Work & Creative Control

KeysCast provides premium cinematic property films, HDR still photography, agent featurettes, and social media reels. All production, pacing, visual framing, lighting setups, and post-production editing are guided by our professional creative judgment, drawing on veteran videography experience since 2007. Special styling requests or edit specifications must be submitted in writing prior to the shoot date.

2. Property Preparation & Condition

The Client is solely responsible for preparing the property prior to the scheduled shoot time. To ensure optimal cinematic results, the home must be fully styled, cleaned, and decluttered. KeysCast shoots properties in their "as-is" condition at the time of the booking. We do not clean, stage, rearrange furniture, or remove physical property clutter, and are not liable for listing presentation outcomes resulting from unstyled homes.

3. Weather Rescheduling & Cancellations

Outdoor production and aerial views in the Florida Keys are highly dependent on lighting and local weather conditions.

  • Weather-Related Changes: If high winds, rain, storm systems, or safety concerns prevent a successful shoot, KeysCast reserves the right to reschedule the project. No fees will apply to changes forced by weather safety conditions.
  • Client Rescheduling: Requesting a schedule change within 24 hours of the agreed shoot time for reasons other than weather may result in a $150 rescheduling fee.

4. Billing, Invoices, and Delivery

Invoices are generated upon project scheduling or asset completion. Payment is due in full within 14 days of asset delivery or as indicated on the invoice agreement. KeysCast reserves the right to withhold high-resolution file delivery, deliver media with diagnostic watermarks, or suspend the active licensing of deliverables if payment remains outstanding past the due date.

5. Licensing & Intellectual Property Rights

We respect copyright integrity and manage licensing with strict standards:

  • Ownership: KeysCast retains the copyright and full intellectual property ownership for all captured media, including photographs, property films, social reels, raw footage, and audio curations.
  • Agent Usage License: Upon full payment of the project invoice, KeysCast grants the Client a non-transferable, non-exclusive license to use the final delivered assets solely for the marketing of the specific listing property on MLS, brokerage sites, and agent social channels. This license remains active only for the duration of the agent's listing cycle.
  • Third-Party Restrictions: The media license is granted exclusively to the booking Client. Third parties (including builders, stagers, designers, contractors, or subsequent listings agents) may not reuse the media. Secondary commercial licenses must be purchased directly from KeysCast.
  • Studio Marketing: KeysCast reserves the right to use final media assets for studio promotion, social media posts, and design portfolios.

6. Limitation of Liability

In the unlikely event of technical malfunction, file corruption, visual asset damage, or production delay, KeysCast's maximum liability is limited strictly to a refund of the fees paid by the Client for the affected service.

7. Governing Law

These Terms shall be interpreted, construed, and enforced in accordance with the laws of the State of Florida. Any legal action or dispute arising from these Terms must be filed in Monroe County, Florida.
